Meeting was called to order at 6:00 p.m. by President Harold Dickerson.


The Pledge of Allegiance was recited.


Council Members Present: H. Dickerson, Phyllis Dickerson, Christine Williams, Robert Gentner,

Kim Kollek-Jewell, Cathy Mulholland, and Tom Cameron.


Absent: None.


Also Present: Police Chief: Matt Balsley, Attorney: John Gormley, Treasurer: Brian Swett, and

Clerk: Karen McGuire.


Additions / Deletions to Agenda: Add: 11.3 Consumers Energy


Guest Comments on the Agenda: None.


MOTION by H. Dickerson, seconded by Kollek-Jewell to approve the agenda as amended. All ayes.

Motion carried.


MOTION by Cameron, seconded by Mulholland to approve the November 26, 2013 minutes. All ayes.

Motion carried.

9.         Public Hearing

9.1       Ordinance to Amend Zoning Ordinance


President Dickerson opened the hearing for public comments. No comments were presented. President Dickerson closed the public hearing.




10.1     Personnel / Police / Transfer Station / Insurance / Retirement

Chief Balsley announced that the CPR class has been rescheduled to Monday, January 6th at 1:00 p.m.

He mentioned that Williams has asked about the progress of the property maintenance enforcement for the St. Vincent building on Main Street. Balsley has been unable to connect with Bert Gale at AGS for a report but will keep trying.


Chief Balsley explained that thirteen applications were received for the part-time positions but seven of them were not MCOLES certified. There are three possibilities for interview. One application came in one day after the deadline so he is asking permission to be able to accept it.


MOTION by H. Dickerson, seconded by Williams to extend the deadline for applications by one day.

All ayes. Motion carried.


Balsley would like to set an appointment with the Personnel Committee for interviews as soon as possible.


Because of the lack of applications received Chief Balsley is worried about not being able to fill two part-time positions.  As the Department is struggling to get hours filled now he would like to post the full-time

position within the Department and advance one of the current part-time officers to full-time right now. He would ask for a letter of interest from the officer(s) and then schedule an interview with the Personnel Committee who would bring their recommendation to the Board.


MOTION by Cameron, seconded by H. Dickerson to allow the Police Chief to post the full-time position within the Department. All ayes. Motion carried.


Balsley presented the November report. The Department responded to 55 complaints for the month. Chief Balsley also pointed out that the snow Ordinance in now in effect. All snow and/or ice must be removed from sidewalks in the right-of-way 24 hours after the snowfall ends. There is no parking on Village streets between the hours of 3:00 a.m. and 7:00 a.m. to accommodate snow plowing.


10.2     DPW / Municipal Buildings / Park

Williams asked if the DPW has gotten the cold patch to repair potholes on Britton Road. Chief Balsley responded that they worked on it two days last week. Cold patching is only a temporary fix.


Cameron asked about having the DPW begin plowing residential sidewalks again, at least in the old town district. They haven’t cleared residential sidewalks for the past few years since they went to only two employees. There was discussion about hiring someone to clear the walks, what sidewalks to include, and a possible fee. Cameron said he felt it would be good for Village residents and would free up the Police Department from having to enforce the Ordinance. H. Dickerson will talk with DPW and report back to the Board.

No Report. The next meeting will be Tuesday, January 14th at 5:00 p.m.


10.8     Budget

No Report. The Budget Committee will meet on Tuesday, December 17th at 6:00 p.m.




11.1     Emergency Protocol

Chief Balsley reported that he has come up with a basic idea and is working out the details with Gormley.


11.2     H.S.A. Additional Deposit

There was discussion at the last meeting but more information was needed to make any decision. Clerk presented budget and premium information for discussion. It was decided that going forward there needs to be more clarification as to when employer contributions will be made. It will be reviewed for the budgeting process also. There is need for a written policy and/or guidelines for the Personnel Manual.

Topic will be added to the January agenda.

MOTION by Gentner, seconded by Cameron to, this year; add an additional $250.00 to each of the four full-time employee’s H.S.A. accounts, effective immediately, with the understanding that it may not be the same next year.


Roll Call: Ayes: Kollek-Jewell, Cameron, Mulholland, Williams, P. Dickerson, Gentner, H. Dickerson. Nays: None. Absent: None. Motion carried.


11.3     Consumers Energy

Consumers has replaced all the old mercury lights and created a new map depicting the location of everything they own in the Village. They sent a one year contract for signatures along with a Resolution for Board approval. They are not proposing any further changes but have reassessed all equipment to make sure it is accurately mapped and accounted for. There was discussion.


TABLE until Clerk contacts Consumers to see what will happen if we don’t sign and to see if they can delete paragraph 8 from the contract.




12.1     Adopt Ordinance to Amend Zoning Ordinance

Gormley summarized that the Zoning Committee has been working on the Amendment for a couple of years. It has been reviewed twice by the zoning administrator and once the engineer. The Committee tried to update and simplify the Ordinance to make it easier to understand and more user friendly. It basically consolidates all the Amendments since the Ordinance was adopted in 1983and includes a new zoning map. They split the residential area into two districts, old town and new town. They shrunk the setbacks in old town hoping to help avoid the need for so many variances and help with non-conforming properties. Now all the zoning rules and regulations are included in the original 1983 Ordinance and this Ordinance to Amend the Zoning Ordinance.


MOTION by H. Dickerson, seconded by P. Dickerson to adopt the Ordinance to Amend the Zoning Ordinance.


Roll Call: Ayes: Gentner, Mulholland, Cameron, P. Dickerson, Williams, Kollek-Jewell, H. Dickerson. Nays: None. Absent: None. Motion carried.


Ordinance must be published.


12.2     Consider Sewer Rates for 2014

Going forward and following Ordinance No. 05-01 consideration for the sewer rate for the coming year will be on the last meeting agenda of the year. The Clerk will automatically follow the Ordinance instructions unless the Board votes not to. It will take no action by the Board to follow the Ordinance already on the books.

MOTION by Gentner, seconded by Kollek-Jewell to pay the bills. (List attached).

Guest Comments:

Joseph Bacigal asked for sewer information not readily available at the meeting but available with a FOIA request. He also gave his opinion on the sewer rate increase and the Clerk’s ability to disclose information without the compliance of FOIA.


Charles Rothney commented that there were a lot on non-conforming parcels when the Zoning Ordinance was adopted in 1983 and it seems like the Zoning Committee has cleaned it up. He asked about the new zoning map.


Other guests also asked about the Zoning Ordinance. Gormley re-summarized and explained the changes.


MOTION by Gentner, seconded by H. Dickerson to adjourn the meeting. All ayes. Motion carried.
