This Meeting was held as a Virtual Meeting due to the COVID-19 pandemic, under the authority of Executive Order No. 2020-75 of the Office of the Governor of the State of Michigan.

Meeting was called to order at 6:12 p.m. by President Harold Dickerson.

 

Council Members Present: Belinda Markell, Philip Hruska, Cathy Mulholland, Robert Peterson,

Todd Scott, Phyllis Dickerson, and Harold Dickerson.

 

Absent: None.

 

Also Present: Attorney: Chris Johnson, Police Chief: Matt Balsley, and Clerk: Karen McGuire.

9.1       Personnel / Police / Transfer Station / Insurance / Retirement

No Report.

 

9.2       DPW / Municipal Buildings / Park

There was discussion about re-opening the Park now that the restrictions have been relaxed. Will be added to the next meeting agenda.

 

9.3       Streets / Sidewalks / Newsletter / Web Site

  1. Hruska reported that the street construction is almost completed, and the sidewalk work has begun.

 

9.4       Sewer / Codes

No Report.

 

9.5       Zoning / Ordinances / Annex / 425 / DDA

No Report.

 

9.6       SSESA

  1. Mulholland reported that SSESA has taken on Durand. There is lots of remodeling to be done and runs have increased.

 

9.7       Homecoming

9.8       Budget

  1. Hruska reported that the Budget Committee met on Sunday. Right now, in all the Funds, both the expenses and the revenues are under budget for the year.

 

UNFINISHED BUSINESS

 

10.1     Work Share Program / Reduced Hours

  1. Hruska said that the Budget Committee recommends that the Village stay on the program. Department Supervisors can decide if employees need to go back to 40 hours per week.

 

10.2     Offer on Lagoon Sprayer

  1. Richardson, the lagoon property farmer, offered $4,000. His biggest problem is moving the sprayer. Valley has had no takers. H. Dickerson will reach out to Valley again. Will check to see if any parts are useable on the other rig. TABLE.

 

10.3     ORV Ordinance

Chief Balsley reported that C. Johnson sent some options to consider, a noise ordinance versus a motorcycle ordinance. He is looking for Council input. There was discussion about State ordinances to consider, ORV definition, enforcement difficulty, who to issue a citation to, and dollar amounts for fines.

Chief Balsley said that the Village Noise Ordinance needs updated and if the presented language is enforceable it would cover the issues. He feels that the ORV Ordinance suggestions would be easier to enforce than the decibel way. He likes the way this is heading but wants a bit more time and discussion to clean it up a bit before adopting. Lot size is another important factor to consider.

10.4     Pump for Lagoons

  1. Dickerson reported that the pump is on order and should be in next week. No further information of installation cost.

 

NEW BUSINESS

 

11.1     457 Plan – Coronavirus-Related Relief

  1. Hruska reported that as part of the CARES Act, participants can withdraw from their 457 Plan account, if they have been affected by the pandemic, without the 10% early withdrawal penalty being applied.

The Board needs to approve the modification to the Village Plan.

 

MOTION by P. Dickerson, seconded by H. Dickerson to adopt this option to the Village’s 457 Plan

11.2     Bar

The Morrice Bar wants to have an outdoor band event on October 3rd or 17th. Liz, from the bar, explained the presented proposal. It will be a 3-hour event, there will be an enclosed tent on the bar side of the alley for the band and extra tables with an orange fence surrounding it all. Masking and social distancing will be required. May use RSVP to control the number of people. There will be a port-a-potty to alleviate congestion inside. C. Johnson suggested they may need to check with the liquor commission to see if they fit under a bar or a restaurant in requirements and to make sure they can have indoor and outdoor dining. Liz said they made the 70/30 government cut off. Chief Balsley asked about entrances to the tent. There are two doors and there will be an employee at each door. He asked about security or a bouncer.  The bar will not have an issue having more staff on hand for control.

MOTION by P. Hruska, seconded by C. Mulholland to approve the Morrice Bar’s request for the proposed Special Event for October 3rd, with an alternative date of October 17th, as long as they are in compliance with any Executive Orders in place on the day of the event.
