REGULAR COUNCIL MEETING

Tuesday, October 13, 2020

6:00 p.m.

Meeting was called to order at 6:00 p.m. by President Harold Dickerson.

 

The Pledge of Allegiance was recited.

 

Council Members Present: Harold Dickerson, Phyllis Dickerson, Philip Hruska, Belinda Markell,

Todd Scott, and Robert Peterson.

 

Absent: Cathy Mulholland.

 

Also Present: Attorney: John Gormley, Police Chief: Matt Balsley, and Clerk: Karen McGuire.

MOTION by H. Dickerson, seconded by P. Hruska to approve the agenda. All ayes. Motion carried.

 

MOTION by P. Hruska, seconded by T. Scott to approve the September 22, 2020 minutes as presented.

All ayes. Motion carried.

COMMITTEE REPORTS

 

9.1       Personnel / Police / Transfer Station / Insurance / Retirement

Chief Balsley reported that the Bar event went well. All is good in the Village. He presented Complaints Response Reports for three months.

 

9.2       DPW / Municipal Buildings / Park

No Report.

 

9.3       Streets / Sidewalks / Newsletter / Web Site

Jeff Philips was in attendance wondering about an issue with his payment. P. Hruska responded that there is a section of sidewalk still not completed. There was discussion regarding the process for figuring out what work was to be done and where and what work has been done and billed. It was decided that a 5’ x 5’ section of sidewalk at 509 Main Street, by the railroad tracks, was supposed to be replaced but was not. This section was not billed to the Village. There was also a section at the Senior Center that was not supposed to be replaced but was. Going forward the Village will need to have more written details regarding the work to be done.

 

MOTION by B. Markell, seconded by T. Scott to pay J. Philips for the work that has been done and the Village will pay 100% of the block not yet completed the next time sidewalks are done.

UNFINISHED BUSINESS

 

10.1     Offer on Lagoon Sprayer

  1. Dickerson reported that the lagoon operator said we shouldn’t take less than $10,000.00 for the old rig. It can sit out there, and he can use tires and parts off it for the small sprayer. The new pump was installed for the new sprayer and it is working great. P. Hruska asked about the farmer being able to till next year and about every two years after that to help keep the ruts down. Gormley said the contract would need to be amended. Will have to find out exactly how he wants to till.

 

10.2     ORV Ordinance

Chief Balsley presented two separate Ordinance drafts – the one that was in Council packets is for the regulation of off-road vehicles in the Village and the other one, that was just distributed, is for noise. The Noise Ordinance will be to update and incorporate the old Noise Ordinance. There was discussion regarding both drafts. A couple of typos were discovered. Chief Balsley asked if anyone wanted a copy of the old Noise Ordinance for comparison to the new draft.

 

MOTION by P. Hruska, seconded by T. Scott to approve the Ordinance to Regulate the Use of Off-Road and Other Vehicles, with the changes as outlined, and to TABLE the Noise Ordinance to the next meeting.

NEW BUSINESS

 

11.1     Park – Reopening

There was discussion about reopening only the outside portion of the Park for general use with no rentals or reopening both the inside and the outside for general use and rentals. With the pandemic health concerns still in place it was decided not to reopen the inside. There will be no rentals, either inside or outside, at this time. The play equipment and the grounds will be open for recreational purposes. The restroom will not be available to the public.

 

MOTION by B. Markell, seconded by P. Dickerson to reopen the outside portion of the Park only, with no rentals at this time.

11.2     Next Meeting – October 27th

Motion by H. Dickerson, seconded by P. Hruska to cancel the next regular Council Meeting scheduled for October 27th.

11.3     Schedule Public Hearing – Morrice Road Condos

The Council needs to hold a Public Hearing for the Site Plan Review for the Morrice Road condo project.

MOTION by P. Dickerson, seconded by H. Dickerson to set the Public Hearing for the next Regular Council meeting on November 10th, pending the Planning Commission’s recommendations are received prior to the posting deadline.

Review Financial Statements / Pay Bills

 

MOTION by H. Dickerson, seconded by P. Hruska to pay the bills as presented. (List Attached.)

Announcements / Correspondence:

Clerk reported that the annual financial audit has been completed. A representative of Gabridge & Company will attend a meeting to present the report or will send a written review of the audit highlights, whichever the Board prefers. It was decided that the written review will be acceptable and appropriate for this year.

  1. Scott thanked Chief Balsley for his work on the Ordinances and R. Peterson and P. Hruska for their work on the sidewalk project.
